EducationCounsel’s Preliminary Guidance Regarding the U.S. Supreme Court’s Decision in SFFA v. Harvard and SFFA v. UNC.

This preliminary draft provides initial guidance regarding the Supreme Court’s SFFA opinion. We offer analysis of what the Court held and why, potential implications for higher education, and five actions higher education institutions and leaders should take now to lead on equity and diversity in light of the Court’s decision.  This initial guidance is directed toward higher education institutions and leaders.  Updates and additional, broader frameworks and guidance will follow.
