DEEP DIVE: EducationCounsel Quarterly Federal Update

This update is intended to provide a deeper understanding of key early childhood education, K-12 education, and higher education policy issues that have received attention on the federal level by the Administration and Congress over the past quarter, and how they could continue to play out in the coming months.

The quarterly update was finalized prior to the March 14 announcement that the Department of Education is investigating more than 50 institutions of higher education regarding “the use of racial preferences” in education programs and activities. Additionally, on March 13, a federal judge in Maryland issued a 14-day temporary restraining order in a case brought by 20 Democratic Attorneys General, which requires 18 federal agencies, including the Departments of Education and Health and Human Services to reinstate probationary employees while the lawsuit proceeds. EducationCounsel plans to provide more information on these announcements during the week of March 17.
